GBRIDGE SOFTWARE END USER LICENSE AGREEMENT IMPORTANT-READ CAREFULLY: By using, copying or distributing all or any portion of the Gbridge software ("Software"), you must agree all terms in this agreement. If you do not agree, do not use this software. 1. Ownership: Gbridge Software is fully owned by Gbridge LLC ("Gbridge"). Gbridge own the title, copyright and other intellectual properties in the Software. The Software is licensed, not sold. 2. License: Gbridge grants user the license to use the Software, free of charge, if and only if user accepts all the terms listed in this agreement. 3. Disclaimer of Warranties and Liability: 3.1 NO LIABILITY: SOFTWARE IS BEING PROVIDED TO YOU FREE OF CHARGE. ACCORDINGLY, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT GBRIDGE WILL HAVE NO LIABILITY IN CONNECTION WITH YOUR USE OF SOFTWARE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE GBRIDGE OR ITS EMPLOYEES, CONTRACTORS, AGENTS, DISTRIBUTORS OR SUPPLIERS BE LIABLE FOR 1). ANY SPECIAL, INCIDENTAL, DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LEAK OR LOSS OF INFORMATION, LEAK OR LOSS OF DATA, LOSS OF BUSINESS OPPORTUNITY, LOSS OR DAMAGES TO PROPERTY OR ANY PECUNIARY LOSS,) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF GBRIDGE HAS BEEN ADVISED ON THE POSSIBILITY OF SUCH DAMAGES. 2). ANY LOSS OR DAMAGE WHICH MAY BE INCURRED BY YOU, INCLUDING BUT NOT LIMITED TO LOSS OR DAMAGE AS A RESULT OF YOUR FAILURE TO KEEP YOUR PASSWORD OR ACCOUNT DETAILS SECURE AND CONFIDENTIAL. YOUR ONLY RIGHT OR REMEDY WITH RESPECT TO ANY PROBLEMS WITH SOFTWARE IS TO IMMEDIATELY UNINSTALL AND CEASE USE OF SOFTWARE. 3.2 No warranties: The Software is provided "as is" with no warranties as to performance and merchantability or any other warranties whether expressed or implied. You use the Software at your own risk. 4. Permitted license uses and restrictions: 4.1 General use. You may install and use the Software on your compatible computer. You shall not use the Software to share any files that are copyrighted or conduct any activity that is against your local law. 4.2 No Modification. You may not modify, adapt or create derivative works based on the Software. 4.3 Limitation on reverse engineering. You may not reverse engineer, decompile or disassemble the Software, except and only to the degree that is expressly permitted by applicable law notwithstanding this limitation. 4.4 New Versions of the Gbridge Software: Gbridge, in its sole discretion, reserves the right to add additional features or functions, or to provide programming fixes, updates and upgrades, to the Software. Gbridge has no obligation to make available to You any subsequent versions of the Software. You may have to enter into a renewed version of this Agreement, in the event you want to download, install or use a new version of the Software. 5. Privacy and No spyware policy: The Software does not contain spyware or adware of any kind. The Software does not come bundled with any third party software other than UltraVNC as described below. If you choose to provide us with personal information by sending an e-mail to our sales or support team, we use that information to respond to your message only. We do not collect personal information for any other purposes. 6. Consent to use of data: You agree that Gbridge may collect and use technical information gathered as part of the product support services related to the Software. Specifically upon your explicit approval, the Software can send crash report information to Gbridge. Gbridge may use this information solely to improve our products or to provide customized services or technologies to you and will not disclose this information in a form that personally identifies you. 7. Miscellaneous: 7.1 Complete agreement: This License constitutes the entire agreement between the parties with respect to the use of the Software licensed and supersedes all prior understandings regarding such subject matter. No amendment to or modification of this License will be binding unless in writing and signed by Gbridge. If any provision of this EULA is held to be void, invalid, unenforceable or illegal, the other provisions shall continue in full force and effect. 7.2 Encryption: We use AES (Advanced Encryption Standard) 128 bit software to encrypt data sent over the network. Do not use the Software if usage of data encryption is not allowed by local law. 7.3 New Versions: Gbridge reserves the right to change this Agreement at any time by publishing the revised Agreement on the Gbridge Website. The revised Agreement shall become effective within thirty (30) days of such publication, unless You expressly accept the revised Agreement earlier by clicking on the accept button. Your express acceptance or Your continued use of the Gbridge Software after expiry of the notice period of thirty (30) days, shall constitute Your acceptance to be bound by the terms and conditions of the revised Agreement. Gbridge reserves the right to change any of the Additional Terms from time to time and such changes shall become effective either within thirty (30) days of publication of the revised version on the Gbridge Website (unless You expressly accept the revised terms earlier by clicking on the accept button if this option is made available), or within the time frame set out in the applicable terms if different. 7.4 Google: Gbridge is in no way affiliated with or endorsed by Google Inc. Gbridge use your Google account for the purpose of authentication and connection to your friends only. 8.
